Social Security Disability Insurance is a federal program that helps those who have become disabled from work when:

• They are unable to engage in any “substantial gainful activity” due to an illness or disability and;
• They will not be able to return to work for 12 months or more and;
• They have accumulated enough work credits in the last 10 years to qualify
• A work credit is given for every three months of work performed

What is the difference between SSDI and SSI?

SSDI is for those who have put in the required work time in the previous 10 years. SSI stands for Supplemental Security Income. SSI is for those who have not accumulated enough work credits but who are mentally or physically unable to work.

What if I have been denied in the past?

A previous SSDI denial should not stop you from reapplying if you feel your condition has not improved or has worsened. It is not unusual for Claimants to be approved after multiple claims. What is the SSDI application process?

The Social Security process can be a lengthy one but, here at ADA, we know how to make it as efficient and painless as possible. If you haven’t applied, we’ll help you with your social security disability application. If you’ve applied for disability benefits and been denied, we’ll take your appeal, monitor your medical treatment and represent you at a hearing before an Administrative Law Judge. Put simply, we take the legal burden off of your shoulders so you can focus on your health.

What will a disability lawyer cost me?

Absolutely nothing out of your own pocket! When we win your Social Security claim, you will receive “back money” that covers the time between your disability’s onset and your favorable decision. Federal law mandates that an attorney can only charge 25% of that back money or $7,200, whichever is less. And remember, if we don’t get you disability benefits, you’ll never pay us at all.

Do I need to be under a doctor’s care?

In short, yes. While some disabilities that stop someone from working cannot be treated by a doctor, this is rare. It will be extremely important that you keep up with your medical treatment while your claim is pending. Social Security will want to see documented evidence of your disability.

Can I work while I apply or collect SSDI?

Yes, you can. Currently, you are allowed to make up $1,470 per month and still stay on SSDI benefits.

What SSDI benefits can I get?

When ADA helps you with your Social Security Disability claim, you can expect to receive back benefits that equal all of the disability checks you would have received from the date of your disability through the date of your positive decision. You’ll also begin receiving monthly disability checks.
